New England Biologics explicitly prohibits and does not support the use of its products in any manner that violates FDA regulations, including but not limited to their use as pharmaceuticals, dietary supplements, or medical devices. Customers are solely responsible for ensuring that their research activities comply with FDA regulations, including obtaining necessary approvals for clinical research. Certain countries may classify research peptides as controlled substances or require specific import permits.

Shipping Process: Orders are processed and shipped via secure, reliable carriers. Shipping times are estimates only and are not guaranteed. Delivery times may vary significantly based on destination, customs processing, international regulations, and carrier performance. We are not responsible for delays caused by customs inspections, regulatory holds, or other circumstances beyond our control.

We are not responsible for delays, loss, damage, seizure, or rejection of products during transit, including those caused by customs inspections, regulatory actions, international shipping complications, or carrier performance.

Refused, Seized, or Undeliverable Orders: If an order is refused, seized by customs, or undeliverable due to an incorrect address, incomplete documentation, customs issues, regulatory restrictions, or other customer error, you are responsible for any additional shipping costs, duties, fees, or losses. No refunds will be issued for orders refused by customers or seized/rejected by customs or regulatory authorities.

4. Returns and Refunds

While our products are manufactured in facilities that comply with WHO/GMP and ISO 9001:2015 quality standards, the suitability, appropriateness, and fitness of our products for your specific research purposes, applications, or regulatory requirements is your sole responsibility to determine and verify.

Before using any product, you should independently confirm and verify all critical information, including but not limited to product specifications, purity levels, molecular weight, sequence accuracy, storage requirements, handling procedures, safety data, and regulatory compliance, by consulting the product packaging, accompanying documentation, certificates of analysis, material safety data sheets (MSDS), and other authoritative sources.

New England Biologics disclaims any and all liability for research outcomes, experimental results, data loss, contamination, equipment damage, personal injury, property damage, or any other consequences, damages, or losses arising from or related to the purchase, handling, storage, or use of our products, regardless of the cause. As expressly stated in our Terms and Conditions, all products are intended and sold strictly for in vitro laboratory research only and are not intended, designed, approved, or authorized for human use, veterinary use, clinical applications, diagnostic purposes, therapeutic purposes, or consumption of any kind, in strict compliance with U.S. Food and Drug Administration (FDA) regulations and international regulatory requirements.

FDA Compliance and Research Use

All products sold by neb.co are research chemicals intended solely for in vitro laboratory research and are not approved, cleared, or authorized by the FDA for human consumption, medical treatment, diagnostic purposes, therapeutic applications, or veterinary use. The FDA classifies unapproved peptides as unapproved new drugs under the Federal Food, Drug, and Cosmetic Act (FD&C Act), and their use in humans or animals is strictly prohibited unless conducted under an FDA-approved Investigational New Drug (IND) application or other appropriate regulatory authorization.

New England Biologics does not warrant, represent, or guarantee that its products comply with FDA requirements, regulations, or standards for any use beyond in vitro laboratory research conducted in controlled settings by qualified researchers. You are solely and exclusively responsible for ensuring that your purchase, possession, handling, storage, and use of our products complies with all applicable FDA regulations, DEA requirements, and other federal, state, local, and international laws, regulations, ordinances, and regulatory requirements in your jurisdiction.

New England Biologics expressly disclaims any and all liability for misuse, unauthorized use, illegal use, or non-compliant use of its products in violation of FDA guidelines, DEA regulations, or other legal or regulatory requirements, and such misuse is undertaken entirely at your own risk and liability.

International Regulatory Compliance

Customers outside the United States are solely responsible for ensuring compliance with all applicable laws, regulations, import/export restrictions, and regulatory requirements in their country or jurisdiction, including but not limited to regulations governing the import, possession, handling, storage, and use of research chemicals and peptides. Regulatory requirements vary significantly by country and jurisdiction, and it is your obligation to understand and comply with all applicable requirements before ordering.

Limitation of Liability

As partial consideration for your access to and use of the Site and its content, services, and products, you expressly acknowledge and agree that New England Biologics, its affiliates, subsidiaries, officers, directors, employees, agents, suppliers, consultants, and partners are not liable or responsible for any decisions, actions, omissions, or inactions you take or fail to take based on the Site’s content, information, materials, or resources.

The aggregate liability of New England Biologics, its affiliates, subsidiaries, officers, directors, employees, agents, suppliers, consultants, and partners, arising from or related to your access to or use of the Site, your purchase or use of products, or any other matter related to these Terms, regardless of the form of action or claim (whether in contract, warranty, tort, negligence, strict liability, fraud, misrepresentation, or otherwise), is strictly limited to the total purchase price of the specific items you purchased in the applicable transaction giving rise to the claim.

In no event shall New England Biologics, its affiliates, subsidiaries, officers, directors, employees, agents, suppliers, consultants, or partners be liable for any direct, indirect, special, incidental, consequential, exemplary, or punitive damages, even if advised of the possibility of such damages, including but not limited to damages for loss of data, research outcomes, business profits, revenue, opportunities, goodwill, use, equipment damage, personal injury, emotional distress, or any other pecuniary or non-pecuniary loss.

This is a comprehensive limitation of liability that applies to all losses, damages, claims, and causes of action of any kind or nature whatsoever. If you are dissatisfied with the Site, its content, services, products, or these Terms, your sole and exclusive remedy is to discontinue using the Site and cease purchasing our products.

Because some jurisdictions do not allow the exclusion or limitation of liability for incidental, consequential, or certain other types of damages, the above limitations may not apply to you in whole or in part. However, in such jurisdictions, our liability shall be limited to the greatest extent permitted by applicable law, and the remainder of this Disclaimer and these Terms shall remain in full force and effect.
